MahaRERA Pushes for Developer Accountability with Self-Certification Mandate

The Maharashtra Real Estate Regulatory Authority (MahaRERA) has introduced a draft regulation mandating self-certification for project quality assurance by developers.

Aimed at ensuring homebuyers receive residences of superior quality, the proposed regulation focuses on various technical aspects crucial to construction integrity, including structural design, stability, and fire safety measures. Under the new framework, developers will be required to provide an annual self-declaration detailing the project’s adherence to quality parameters such as structural robustness, material quality, workmanship standards, and compliance with fire safety norms. This initiative underscores MahaRERA’s commitment to elevating construction standards and minimising instances of defects or substandard construction practices. The draft regulation, currently open for public feedback until May 23, emphasises the importance of construction quality in enhancing consumer satisfaction and trust in the real estate market. Notably, the proposed system of self-certification is envisioned as an optional measure during the initial phase, with developers voluntarily adopting the practice being acknowledged on the MahaRERA website.

According to a spokesperson from MahaRERA, the move towards self-certification aligns with the organisation’s broader objective of promoting accountability and transparency within the real estate industry. By encouraging developers to proactively assess and declare the quality of their projects, MahaRERA aims to empower homebuyers with reliable information while fostering a culture of responsible construction practices. Furthermore, the draft regulation highlights the legal framework provided by the Real Estate (Regulation and Development) Act 2016, which holds developers accountable for rectifying structural defects within a stipulated period. This provision serves to safeguard the rights of flat purchasers and underscores the importance of proactive defect management in ensuring consumer welfare.
