Hyderabad Homeowners Get Relief As TG-RERA Enforces Builder Commitments
Hyderabad’s real estate regulatory framework received a significant boost after the Telangana Real Estate Regulatory Authority (TG-RERA) directed a developer to complete all pending infrastructure and common amenities at a residential villa project in Kompally. The order reinforces the authority’s commitment to protecting homebuyer interests and ensuring compliance with project commitments.
The directive was issued to M/s Balaji Constructions following a complaint filed by the Balaji Elegancia Villa Owners Mutually Aided Co-operative Maintenance Society. Residents alleged that several facilities promised in project brochures and sale agreements remained incomplete despite occupation of the villas. Among the pending works identified were a clubhouse, sewage treatment plant, water treatment facilities, 100 percent power backup systems and essential security infrastructure. Residents argued that the absence of these amenities affected the quality of life and reduced the value of the residential community.
To verify the claims, TG-RERA appointed the Engineering Staff College of India (ESCI) to conduct an independent inspection of the project. The assessment confirmed that while a substantial number of villas were already occupied, several key civic and recreational facilities had not been completed even after the project’s statutory completion deadline of September 1, 2024. Invoking provisions under the Real Estate (Regulation and Development) Act, 2016, TG-RERA rejected objections raised by the developer regarding the standing of the residents’ association and issues related to project extension status. The authority reiterated that developers are legally obligated to deliver all promised amenities once a project reaches significant occupancy levels. The order directs the developer to complete all pending works within previously committed timelines. For facilities whose deadlines have already expired, TG-RERA has granted a final 60-day window for completion.
Real estate experts note that such regulatory interventions strengthen consumer confidence in the housing sector by holding developers accountable for project commitments. Effective enforcement of RERA provisions is increasingly viewed as essential for improving transparency, project delivery standards and buyer protection across India’s real estate market. The authority has also warned that failure to comply with the order could result in penal action under Section 63 of the Real Estate (Regulation and Development) Act. The decision signals a stricter regulatory approach toward delayed amenities and incomplete infrastructure in residential developments. As Hyderabad’s housing market continues to expand, industry observers believe stronger enforcement of buyer rights and project obligations will play a crucial role in maintaining trust and promoting sustainable growth in the real estate sector.
