Anil Tuteja Bail: SC Gives Chhattisgarh Fresh Legal Route

The Supreme Court has allowed the Chhattisgarh government to approach the High Court for cancellation of former senior IAS officer Anil Tuteja’s bail if he violates its conditions or misuses the concession, while refusing to entertain the state’s challenge to the bail orders granted in fresh corruption cases.

A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana disposed of the state government’s appeal on Thursday. The court clarified that observations made by the High Court while granting bail would be limited to that stage and should not influence the trial court’s assessment of the evidence.

The bench said there was strong suspicion of Tuteja’s involvement in corruption but noted that suspicion would have to be converted into “foolproof evidence” during the trial. “The findings made by the high court are for the limited purpose of granting bail. The trial court shall not be influenced by those observations,” the bench said, according to the report.

The bail orders challenged by the Chhattisgarh government were passed in December 2025 and January 2026. The Supreme Court said that any instance of misuse of bail could be brought to the High Court’s notice, allowing the state to seek cancellation through the appropriate legal process.

Tuteja, a retired IAS officer who held important positions during the tenure of the previous Bhupesh Baghel government, is facing investigations in several corruption cases. These include the alleged liquor scam, alleged irregularities involving the District Mineral Fund and the alleged coal levy scam. The allegations remain subject to proceedings before the relevant courts.

The Chhattisgarh Economic Offence Wing and Anti-Corruption Bureau recently filed their 10th supplementary charge sheet in the alleged liquor scam. The filing named 20 people, including former state Congress treasurer Ramgopal Agrawal, along with 22 firms as accused, according to the report.

The Supreme Court had on May 18 granted Tuteja bail in a corruption case relating to alleged District Mineral Fund irregularities. He had been in jail since January 24, 2024, in connection with various corruption cases before securing bail.

The latest order does not determine Tuteja’s guilt or innocence. It preserves the High Court’s bail decision while confirming that the state can seek cancellation if it presents evidence of a breach of bail conditions. The clarification also separates the court’s assessment at the bail stage from the evidence that will be examined during trial.
