The Noida Labour Commissioner has issued an advisory clarifying the rules for employee bonus eligibility, after misleading information about wages and bonus payments was circulated on social media and other platforms in Gautam Buddh Nagar. The advisory says eligible employees must have worked for at least 30 days in the previous financial year, while establishments must meet specified workforce and operating-age conditions.
According to the advisory reported by Live Hindustan – NCR, employees whose monthly wages do not exceed Rs 21,000 may qualify for bonus payments if they worked for at least 30 days during the previous financial year. The establishment must also have employed at least 20 people and must have been in operation for more than five years.
The Labour Commissioner said bonus payments would be determined at a rate ranging from 8.33 per cent to 20 per cent, depending on the allocable surplus. The advisory further states that employers must ensure payment of the bonus by November 30.
Apprentices, including people working as trainees or apprentices, will not be eligible under the conditions listed in the advisory. The department also clarified that employees appointed after April 1, 2026, will become eligible for the bonus under these rules in the following year.
The advisory was issued after what the Labour Commissioner described as false and misleading information about wages and bonuses was shared through social media and other channels. The department said such unverified messages were creating confusion between workers and employers and could adversely affect industrial peace and public order.
The Labour Commissioner has asked employers to make bonus payments on time and advised workers not to rely on unconfirmed messages. It specifically said that information obtained through Google or ChatGPT should not be treated as reliable without official confirmation from the Labour Department or another government source.
The clarification places the responsibility for resolving eligibility, calculation and payment disputes with the relevant Labour Office in Gautam Buddh Nagar. Workers facing problems have been asked to contact the department for assistance. A helpline number, 8796355216, has also been issued for information about bonus-related issues.
The advisory does not establish that every employee meeting one condition will automatically receive the same amount. Eligibility depends on the combined conditions listed by the Labour Commissioner, while the final percentage is linked to the allocable surplus of the establishment. Employers are expected to complete payments by November 30, and workers can approach the Labour Office if the eligibility or payment process remains disputed.
