Hyderabad RERA Order Highlights Buyer Protection Rules

Hyderabad: The Telangana Real Estate Regulatory Authority (TG RERA) has reinforced the importance of regulatory compliance in the state’s property market by dismissing a refund claim linked to an unregistered real estate project while initiating penalty proceedings against multiple parties for alleged violations of the Real Estate (Regulation and Development) Act. The decision highlights the regulator’s growing emphasis on transparency, accountability and consumer protection in Telangana’s evolving real estate sector.

The case centred on an advance payment made for multiple residential plots in a project located in Yadadri Bhuvanagiri district. During its examination, the Authority found that the transaction and project marketing had taken place before the development secured mandatory registration under the RERA framework. Such registration is intended to ensure that projects meet statutory disclosure requirements before being offered to prospective buyers. The Telangana RERA compliance ruling also distinguished between genuine homebuyers and participants engaged in commercial property transactions. After reviewing the agreements and circumstances surrounding the transaction, the Authority concluded that the complainant’s involvement was aimed at facilitating the resale of multiple plots rather than purchasing them for personal ownership. Consequently, the regulator determined that the complainant did not qualify for the statutory protections available to homebuyers under the Act. The Authority further observed that individuals engaged in property marketing activities are required to obtain registration as real estate agents where applicable under the regulatory framework. It directed the initiation of penalty proceedings against the project’s developers for allegedly marketing the venture before registration, while also initiating action against individuals found to have facilitated transactions without the necessary regulatory approvals.

Urban policy experts say the order reflects the increasing role of RERA authorities in strengthening governance within India’s real estate sector. Since its introduction, the legislation has sought to improve transparency by requiring developers to register projects, disclose key project information and follow prescribed standards before accepting advances from purchasers. These safeguards are designed to reduce information asymmetry, discourage speculative practices and build greater confidence among homebuyers. Legal analysts note that the ruling also serves as a reminder that disputes arising from commercial investment arrangements may not automatically fall within the consumer protection provisions of the RERA framework. Instead, such matters may require resolution through appropriate civil legal processes depending on the nature of the transaction. The Telangana RERA compliance decision comes as Hyderabad and surrounding districts continue to witness significant residential and infrastructure growth. As urban expansion accelerates, experts believe consistent regulatory enforcement will remain essential for ensuring orderly development, protecting genuine buyers and promoting responsible real estate practices.

Strengthening compliance mechanisms, improving project disclosures and encouraging greater awareness of regulatory obligations are expected to contribute to a more transparent property market while supporting sustainable urban growth across Telangana.
