New Delhi HC Allows Apollo Hospital To Charge Parking Fees Legally

New Delhi’s judiciary has cleared the way for Apollo Hospital in Sarita Vihar to amend its lease with the Municipal Corporation of Delhi (MCD), enabling the hospital to impose charges for vehicles using its designated parking area. The decision comes after the hospital challenged MCD’s directive to display “Free Parking” signage and subsequent notices issued without prior warning. Legal experts view this as a significant ruling clarifying the rights of private institutions managing parking facilities on leased public land.

The case builds on a precedent set in November 2023, when the Delhi High Court ruled in favour of Pacific Development Corporation, allowing entities to charge fees in parking lots within their premises. Officials from Apollo Hospital argued that the ruling entitled them to implement a similar system, but the MCD noted that the hospital’s lease deed would first need formal amendment, mirroring the process followed in the Pacific Mall case.The High Court granted the hospital liberty to amend its lease deed with the MCD, formally recognising the right to levy parking charges while ensuring regulatory compliance. The order, experts say, underscores the need for clarity in managing urban parking spaces, balancing public interest with the financial sustainability of private institutions operating on municipal land.

Urban planners emphasise that properly managed parking infrastructure is essential in densely populated areas like Sarita Vihar, where space is limited and traffic congestion is high. Officials point out that controlled parking not only generates revenue for facility upkeep but also encourages more efficient use of limited urban space, potentially reducing illegal street parking and associated traffic bottlenecks.Legal analysts highlight that the decision also reflects a broader trend of clarifying lease rights for private entities in Delhi, particularly when public land is leased for commercial or healthcare purposes. By aligning lease amendments with municipal regulations, the ruling provides a framework for other hospitals, malls, and institutions facing similar conflicts over parking rights and signage.

Officials from the MCD confirmed that the amendment process would ensure that the hospital’s parking operations are fully compliant with municipal laws, while urban governance experts noted that such clarifications reduce disputes and improve service delivery in high-traffic zones.
