A Section 163 BNSS Delhi order is in force across New Delhi district ahead of a proposed protest at Jantar Mantar on October 2 against Chief Election Commissioner Gyanesh Kumar, with restrictions on public gatherings and traffic diversions expected to affect several central Delhi roads.
The prohibitory order under the Bharatiya Nagarik Suraksha Sanhita, 2023, has been imposed to maintain public order, ensure public safety and facilitate smooth traffic movement, according to the report. Security has also been tightened in the national capital ahead of the proposed demonstration.
The order prohibits public meetings and assemblies of five or more people, processions, demonstrations, picketing and dharnas without prior written permission. Slogans and speeches are also prohibited without prior written approval. The restrictions extend to carrying firearms, banners, placards, lathis, swords, sticks, brickbats and similar articles.
Citizens, visitors and other stakeholders have been advised to comply with the order and avoid unauthorised gatherings or prohibited activity. Violations may attract legal action under Section 223 of the Bharatiya Nyaya Sanhita, 2023, along with other applicable provisions of law.
The proposed protest follows an appeal by Aam Aadmi Party MLA and former Delhi chief minister Atishi, who urged people to reach Jantar Mantar at 10 am. The protest is linked to criticism of the Election Commission’s functioning and its handling of the Special Intensive Revision of electoral rolls. In a video message and a post on X, Atishi said the right to vote was under threat and called on people to participate in the demonstration.
The traffic restrictions will affect Jantar Mantar and adjoining stretches, including Connaught Place, Patel Chowk, GPO, Tolstoy Marg, Jantar Mantar Road, Parliament Street and nearby roads. Delhi Traffic Police has advised commuters to avoid Jantar Mantar, Parliament Street, Ashoka Road and adjoining areas wherever possible.
Traffic from Connaught Place towards Patel Chowk may be diverted through alternate routes under the direction of traffic personnel, while movement between Patel Chowk and GPO will be regulated or diverted at designated points. Traffic movement on Tolstoy Marg and Jantar Mantar Road will also be regulated, with motorists advised to use alternate routes. The restrictions and diversions are scheduled for October 2 as authorities prepare for the proposed protest.
