Uttar Pradesh Green Space Law Reshapes Urban Planning

Urban green spaces across Uttar Pradesh are set to receive stronger protection after a judicial push revived enforcement of a decades-old environmental law designed to preserve parks, playgrounds and open land within city limits.

The renewed attention on the Uttar Pradesh green space law follows directions from the judiciary requiring authorities to apply provisions of the state’s 1975 legislation that governs the protection and regulation of parks and open spaces in municipal areas. The law, enacted nearly 45 years ago, mandates that urban parks, playgrounds and open land be formally listed and protected from encroachment or conversion into commercial developments. Under the latest directions, district administrations and planning bodies have been asked to conduct surveys identifying all parks, playgrounds and open areas within municipal boundaries and ensure they are included in official records under the Act. The exercise is expected to cover existing green areas as well as those developed after the law was enacted, widening the scope of protection across expanding urban landscapes.

Officials involved in the process say the directive aims to address a longstanding governance gap where several large parks and open areas were not formally registered under the Act, leaving them vulnerable to redevelopment pressures. Urban planners note that such gaps are common in rapidly growing cities, where land designated as open space in master plans may gradually be repurposed for commercial or institutional activities. The Uttar Pradesh green space law prohibits the alteration or commercial use of land designated as parks or playgrounds without official approval. Authorities can also issue notices to remove encroachments, repair structures or restore areas that have been illegally modified within designated green zones.

Environmental planners argue that stricter enforcement of these rules could reshape urban land management across the state. Cities like Lucknow, Kanpur and Ghaziabad have experienced intense real estate growth over the past two decades, often leading to shrinking per-capita open space availability. Green infrastructure experts say parks and open areas play a critical role in urban resilience. Vegetated spaces help absorb rainfall, moderate city temperatures, improve air quality and provide recreational areas that support public health. In dense cities, even modest increases in protected green areas can significantly improve environmental outcomes. The directive also carries implications for development authorities responsible for city planning.

Projects involving public land—such as commercial events, temporary structures or private leases—may face stricter scrutiny if they occur within designated park zones. Urban policy specialists note that formalising the list of protected green spaces is a crucial step in preventing disputes over land use. Once listed under the Act, these spaces receive legal status that limits their conversion and strengthens accountability among municipal authorities. For rapidly urbanising states like Uttar Pradesh, the renewed enforcement of the Uttar Pradesh green space law signals a broader shift toward recognising ecological infrastructure as an essential component of urban planning.

As surveys and documentation begin across districts, the initiative could reshape how cities balance development with environmental sustainability—ensuring that future growth does not come at the cost of public green spaces that serve as vital urban commons.
