In a high-stakes legal battle over two major infrastructure projects worth ₹14,000 crore, the Maharashtra government defended its decision to disqualify engineering giant Larsen & Toubro (L&T) from the tendering process, asserting that the move was based on substantial grounds rather than arbitrary reasons.
The Supreme Court is set to hear the case on Friday, May 30, following L&T’s appeal against the disqualification.The projects in question include a ₹6,000 crore elevated road from Fountain Hotel Junction at Thane-Ghodbunder Road to Bhayander and an ₹8,000 crore road tunnel from Gaimukh to Fountain Hotel Junction. These initiatives are integral to improving connectivity and easing traffic congestion in the Mumbai Metropolitan Region.L&T challenged its disqualification, arguing that it was not informed of the reasons and that its price bid was not even opened. The company contended that this lack of transparency led to a higher bid being selected, potentially resulting in increased project costs.
During the hearing, Chief Justice of India Justice BR Gavai questioned how L&T, which has executed significant projects like Delhi’s Central Vista, could be disqualified from these tenders. The court also referenced the Uttarakhand tunnel collapse incident, highlighting concerns about the qualifications of the selected bidder.The Maharashtra government, represented by Solicitor General Tushar Mehta and senior counsel Mukul Rohatgi, maintained that the disqualification was justified and sought an additional day to complete discussions on the tenders. The Supreme Court granted this request, scheduling the next hearing for Friday.
The outcome of this case could have significant implications for the tendering process of large infrastructure projects in India, particularly concerning transparency and adherence to established guidelines.
