The Kolkata Municipal Corporation (KMC) has drafted a set of rigorous laws aimed at curbing illegal building activities across the city. The proposed legislation, currently under review by the state government, represents a significant step towards addressing the persistent issue of unauthorised constructions.

The disaster in Garden Reach has acted as a catalyst for the KMC, which has faced numerous legal battles over illegal constructions in recent years. The death toll from the collapse has underscored the urgent need for stronger regulatory measures. The Mayor has been a vocal advocate for tougher laws, arguing that severe penalties are essential to deter individuals and developers from proceeding with unauthorised projects. The draft laws, now with the Urban Development and Municipal Affairs department for approval, include provisions designed to make it increasingly difficult for offenders to evade justice. The new regulations aim to make it challenging for developers to secure bail if they are involved in illegal construction activities. Moreover, the legislation seeks to instil a sense of fear among plot owners who might otherwise be inclined to permit unauthorised development.

In addition to these measures, the KMC has streamlined the process for obtaining construction sanctions. Builders can now apply for permits online, which is intended to eliminate bureaucratic hurdles and reduce the temptation to bypass legal requirements. However, the KMC is also looking to eliminate the option of regularising large-scale illegal constructions, with new laws clearly defining the conditions under which such regularisations can occur. The Mayor has emphasised that the goal of these new regulations is to encourage property owners to seek official approval before embarking on any construction projects. By instituting these strict controls, the KMC aims to enhance safety standards and prevent future tragedies linked to illegal building activities.
