Kolkata Orders Closure of Rooftop Restaurants

The Kolkata Municipal Corporation (KMC) has mandated the immediate closure of all rooftop restaurants across the city.

This directive follows a tragic fire incident at a central Kolkata hotel that resulted in 14 fatalities, including two children. The blaze, which erupted at the Rituraj Hotel in the Burrabazar area, underscored significant lapses in fire safety measures, prompting swift action from municipal authorities. Under Building Rule 117/4, the KMC stipulates that terraces on the topmost floors of buildings must remain common areas with unrestricted access and cannot be subdivided or sold for exclusive use. The recent enforcement of this rule aims to ensure that rooftops are accessible for emergency evacuations and fire refuge, a necessity highlighted by past incidents where locked or obstructed terraces impeded rescue operations.

The KMC has begun issuing formal notices to rooftop restaurant owners, instructing them to cease operations immediately. Failure to comply will result in strict legal action. This policy shift has sent ripples through Kolkata’s hospitality sector, particularly affecting areas like Park Street and Salt Lake, known for their vibrant rooftop dining scenes. The National Restaurants’ Association of India (NRAI) has expressed concern over the abrupt nature of the closures, citing the employment of thousands in these establishments and the significant investment in rooftop venues. Restaurant owners are seeking clarity and possible alternatives that balance safety with economic viability.

The KMC’s action reflects a broader commitment to enforcing building codes and fire safety regulations, aiming to prevent future tragedies and promote sustainable urban development. As the city grapples with the implications of this directive, stakeholders are urged to collaborate in fostering a safer and more compliant hospitality environment.
