The Department of Town and Country Planning (DTCP) has intervened in a dispute involving the Ireo Victory Valley residential society in Sector 67, Gurugram, by issuing a directive to the Resident Welfare Association (RWA) to allow economically weaker section (EWS) flat owners access to their properties and essential amenities.
The move follows a grievance hearing led by Deputy Commissioner during which EWS flat allottees reported being barred from accessing their own homes and enjoying basic facilities available to other residents, including parks and communal areas. This exclusion, they argued, contravenes their rights as property owners and residents of the society. In response to these complaints, Deputy Commissioner instructed the district town planner (enforcement) to act swiftly. Consequently, a notice was issued on Friday mandating the RWA to ensure that EWS residents are granted access to their flats and that all fundamental amenities are restored within a 15-day timeframe.
The notice underscores that non-compliance will result in legal repercussions in accordance with established regulations. Furthermore, the Deputy Commissioner has tasked the district registrar with monitoring the situation closely and enforcing the order if the RWA fails to comply. However, a spokesperson from the RWA contends that the issue arises from a lack of proper entry provisions for EWS flats, as stipulated in the society’s layout plan. The RWA representative claims that neither the DTCP nor the builder has made provisions for EWS entry from Ramgarh village, and asserts that the RWA had not been formally notified or given an opportunity to respond before the notice was issued.
The RWA member also maintained that EWS occupants receive all essential services and are exempt from common area maintenance charges, in line with DTCP norms. Despite these claims, the DTCP’s intervention highlights ongoing tensions and the need for clearer communication and compliance within residential societies. This development underscores the broader challenges of integrating EWS residents into upscale residential environments and ensuring that housing policies are effectively implemented and enforced.
