New Delhi: The debate over transparency in infrastructure governance deepened on Monday as the Supreme Court stayed a Kerala High Court ruling which had categorised Cochin International Airport Limited (CIAL) as a public authority under the Right to Information Act. The apex court’s intervention has temporarily suspended the earlier directive, setting the stage for a detailed examination of whether privately managed but publicly funded infrastructure can be brought under RTI obligations.

The dispute stems from the unique ownership model of CIAL, often hailed as India’s first public private partnership in the aviation sector. Though incorporated as a private company, it has substantial equity participation from the state government and public shareholders, raising questions over accountability in the use of public funds. Legal experts say the ruling could set an important precedent for how the country interprets transparency norms around strategic assets that blend government backing with corporate governance.
